BETWAY SA20 ABBREVIATED TICKET TERMS AND CONDITIONS

THESE CONDITIONS GOVERN ALL TICKETS AND ADMISSION TO ANY VENUE FOR A MATCH. A TICKET HOLDER SHALL, BY USING A TICKET, BE DEEMED TO HAVE BEEN MADE AWARE OF, AND TO HAVE ACCEPTED AND BE BOUND BY THE CONDITIONS. DEFINED TERMS USED BELOW SHALL HAVE THE MEANINGS GIVEN IN THE CONDITIONS.

The Conditions incorporate the Venue Regulations and the Ticket Refund Policy.

3.1 offered publicly (other than through the Official Resale Platform) for sale;

3.2 offered, transferred or used in the course of any business or otherwise for commercial gain; or

3.3 offered, transferred or used in relation to any promotional purpose, as a prize or otherwise bundled with any other goods or services (including as part of any hospitality or travel package), in each case without the prior written authorisation of Africa Cricket Development Proprietary Limited (SA20).

SA20, and/or any Authorised Person may refuse admission to or eject from the Venue without refund a Ticket Holder who, in their reasonable opinion:

4.1 does not produce a valid Ticket upon request;

4.2 seeks to use, or produces for inspection upon request, an otherwise valid Ticket for a category of persons to which the Ticket Holder does not belong (i.e. attempts to or enters the Venue on a ‘scholar’ or ‘pensioner’ ticket, but cannot prove that they belong to such category of person);

4.3 is in breach of any of the Conditions;

4.4 fails to comply with instructions from any Authorised Person, police, steward or other security officer;

4.5 enters any area within the Venue where he/she is not permitted (including the playing field); and/or

4.6 is in possession of a Prohibited Item (see paragraph 7 below).

The Ticket Holder shall not engage in any form of Ambush Marketing and shall not conduct any activity that conflicts with, infringes upon or impairs the rights of any official sponsor, official supplier, broadcaster, licensee and/or any other party which has been granted a commercial association with the SA20, the Tournament and/or the Teams from time to time (Commercial Partner).

The Ticket Holder shall not be entitled to conduct, carry out or cause to be conducted or carried out any promotions, advertising, marketing or other commercial activity in or around the Venue, unless the same has been expressly authorised in writing in advance by SA20 (the Ticket Holder may be asked to deliver up a copy of any such authorisation upon entry to or at any time whilst within the Venue).

The Venue management reserves the right to refuse entry to any person carrying any prohibited or unauthorised item or substances into the Venue. Ticket Holders are reminded to consult the applicable Venue for a full list of prohibited and/or authorised items.

7.1.1 metal cans and glass bottles (other than purchased or provided in the Venue);

7.1.2 fireworks, weapons, firearms, flares and any other items considered dangerous;

7.1.3 banners, signs or other items, objects or clothing displaying political, religious, offensive or race-related messages; and

7.1.4 without limiting the generality thereof, any other dangerous article or substance not referred to above, or any item or substance being worn or carried which in the reasonable opinion of SA20 and/or any Authorised Person, may be considered to be offensive, disruptive, dangerous or likely to infringe any party's rights or any party’s safety or security.

Ticket Holders may be searched (including a search of the Ticket Holder’s bags, clothes, electronic devices and other possessions) by or on behalf of SA20, and/or any Authorised Person prior to entry into or at any time within the Venue for the purpose of monitoring and enforcing compliance with the Conditions (including locating and removing any Prohibited Items). Should the Ticket Holder refuse to be searched, the Ticket Holder may be refused admission to and/or ejected from the Venue without refund or compensation.

It shall be a breach of the Conditions for any Ticket Holder to engage in any conduct (whether through the use of language, gestures or otherwise) which is likely to offend, insult, humiliate, intimidate, threaten, disparage or vilify any reasonable person (including, without limitation, any player, umpire, referee, Authorised Person or other spectator) on the basis of their race, sex, gender, sexual orientation, age, religion, disability, culture, marital status, colour, descent, pregnancy status, nationality or ethnic origin. Such action will not be tolerated and is likely to result in ejection from the Venue, the imposition of other sanctions, such as being banned from the Venue in the future and possible further action including criminal prosecution.

A valid Ticket permits the Ticket Holder admission to the Venue and to view the Match to which it relates from the seat or area specified on the Ticket. SA20 reserves the right at its reasonable discretion to make alterations to the time, date and/or venue of any Match and/or to substitute the seat or area indicated on the Ticket with another position.

No smoking is allowed in the Venue other than in designated areas.

Ticket Holders shall not conduct, carry out or cause to be conducted or carried out any form of illegal and/or unauthorised betting or gambling whatsoever within the Venue, including, to avoid doubt:

13.1 the use any electronic device to engage in any online betting activities in relation to the result, progress, conduct or any other aspect of the Match in attendance, including but not limited to ball-by-ball spread betting and/or the use of betting exchanges;

13.2 the use any electronic device to relay information on the progress, conduct, details or any other aspect of any Match for betting activities, unlicensed commercial activities or any other purposes in contravention of these Conditions, unless authorised or permitted to do so by SA20; or

13.3 the offer to any third party any bribe or other reward to fix or to contrive in any way or otherwise improperly influence the result, progress, conduct or any other aspect of any Match..

If suspected by an Authorised Person of acting or assisting another person or persons acting in breach of paragraph 13 of these Conditions, the Ticket Holder is deemed to have unconditionally accepted and agreed that they will fully cooperate with any enquiries made by SA20, CSA, any Authorised Person and/or any relevant police and crime prevention authorities (including agreeing to be interviewed and providing the Ticket Holder’s name and address, an explanation for the suspicious conduct, and being photographed and/or filmed by an Authorised Person), for the purposes of any criminal investigations or other legal proceedings and/or in connection with any investigation into a potential breach of these Conditions or CSA’s Anti-Corruption Code.

Ticket Holders consent without compensation to the recording of their voice, image and likeness captured by any means whilst present at or about a Venue, and agree to the transmission and use in perpetuity of such material by SA20, its Commercial Partners and any licensee or assignee of SA20.

The Ticket Holder irrevocably and unconditionally consents to the collection, use and insertion into a database by or on behalf of SA20 of personal information provided by the Ticket Purchaser and any other Ticket Holder in accordance with applicable data protection laws for the purposes of implementation of these Conditions, including for administration, communication, enforcement and access control purposes. SA20 may share such personal information with the Teams Venue and other parties as set out in the Privacy Policy and as may be generally and reasonably required for the proper and efficient staging of the Tournament and to give effect to any of its rights in terms of these Conditions. The Privacy Policy details how SA20 use and disclose personal information, how a Ticket Holder can access and/or correct his/her personal information and how a Ticket Holder can make a complaint about SA20’s or the Team’s use or disclosure of personal information.

The Ticket Holder acknowledges that his/her presence at the Venue is at his/her own risk and that, to the maximum extent permitted by applicable local law, none of SA20, the Venue, or any Team, Authorised Persons or Official Ticketing Agents are liable for any loss, damage or harm however arising from the Match and/or Tournament and his/her attendance at the Venue.

All Matches are organised and staged in accordance with the Cricket South Africa’s regulations, applicable laws, Government guidance in force from time to time and approvals from the relevant Local Authority. No guarantee can be given by SA20 that any Match will take place at a particular time or on a particular date, that spectators will be permitted to enter the Venue for any Match in any particular numbers, that capacities may not be reduced after Tickets have been sold, or that any Match will take place at all. All information about times and dates of Matches is kept as up-to-date as possible but should be taken as a guide only and SA20 reserves the right (acting reasonably) to reschedule any Match at any time, without notice and, subject to paragraph 19 below, without any liability whatsoever.

We take all reasonable care to ensure that the prices shown in advance are correct at the time when the relevant information was entered onto the system, but they are not always accurate and should be taken as a guide only.

19.1 a Ticket Holder with a valid Ticket will be entitled to:

19.1.1 a full refund less any reasonable administration fee provided they comply with the process set out at paragraph 23; or

19.1.2 where applicable, to receive the equivalent ticket for the subsequent rescheduled Match via such application procedure as SA20 stipulates.

19.2 Ticket Holders with a Complimentary and/or Suite Ticket will be entitled only to attend the rescheduled Match and not to a refund.

In the event of cancellation of a Match, or a decision being made (whether by SA20 or any third party) that a Match must be played with reduced (or further reduced) capacity or without spectators, an impacted Ticket Holder will be entitled to a full refund less any reasonable administration fee, provided they comply with the process set out at paragraph 23.

In the event of abandonment of a Match after the spectators have been admitted to the Venue but before 7 (seven) full overs of the Match have been bowled, Match Tickets used by the spectators for entry to the abandoned Match shall remain valid for admission to the rescheduled Match (if any). In the event of abandonment of a Match after the spectators have been admitted to the Venue and after 7 (seven) full overs of the Match have been bowled, Ticket Holders shall not be entitled to any refund. For the avoidance of doubt, new Match Tickets may be issued via such application procedure as SA20 stipulates.

In the event of a Match postponement, abandonment or cancellation SA20 will have no liability to Ticket Holders other than as set out in paragraphs 17 to 24, including (but not limited to) for loss of enjoyment, loss of a chance, loss of time, or travel costs or accommodation costs. For the avoidance of doubt, SA20 shall not be responsible for any Match Ticket which is forgotten, lost, stolen, defaced, damaged or destroyed.

Subject to paragraph 24, in order to obtain a refund:

23.1 each Ticket purchaser shall follow the refund claim notice received from Ticketpro;

23.2 the Ticket purchaser shall be required to submit a claim via email to info@ticketpro.co.za including full particulars of all information relating to the Match in question and such ancillary information and documents as Ticketpro may reasonably require (which shall be requested in the refund claim notice); and

23.3 an administration fee of R25.00 (twenty-five rand) will be charged for each refunded transaction, irrespective of the number of tickets or the value of the given transaction

No refunds will be given where there has been a breach of the Conditions.

The resale of tickets without the authorisation of the SA20 is a breach of the Conditions and, in certain circumstances, a breach of ticket sales and/or major event protection legislation and may attract criminal penalties.

No re-entry to stadia will be permitted, once a patron exits the stadia, they will not be permitted re-entry

Except to the extent required by Applicable Law, these Conditions and any dispute or claim arising out of or in connection with these Conditions (including, without limitation, any dispute or claim relating to non-contractual obligations) shall be governed by and interpreted in accordance with South African law and any dispute (including, without limitation, any non-contractual dispute or claim) arising from or in connection with these Conditions or a Ticket Holder’s attendance at a Match shall be submitted to the non-exclusive jurisdiction of the South African courts.

SA20 reserves the right to make amendments to these Conditions from time to time at SA20’s sole discretion and without notice (including, without limitation, by amending or supplementing the Venue Regulations). A full copy of the latest version of the Conditions (as amended, if appropriate) will be available on upon request from SA20.

Each of the provisions set out in these Conditions shall be severally enforceable. Notwithstanding that the whole or any part of any provision(s) of these Conditions may be declared void, ineffective or unenforceable in any respect by any competent court in any jurisdiction, the provision(s) in question (or part thereof, as the case may be) shall be severed to the extent necessary and the other provision(s) of these Conditions and the remainder of the provision(s) in question (as applicable) shall continue in full force and effect.

1.2 This Privacy Policy sets out what we will do with any Personal Information we collect from or about You (“the User”, “You”, “Your”), or that You provide to SA20, when You use the digital platform located at the domain name www.sa20.co.za (“the Website), its features and/services or when you otherwise interact with SA20.

1.3 By agreeing to this Privacy Policy, You provide us with Your express consent and agreement that we may collect, get, receive, record, organise, collate, store, update, change, retrieve, read, process, consult, use and share Your Personal Information in the manner set out in this Privacy Policy. When we do one or more of these actions with Your Personal Information, we are “Processing” Your Personal Information (and “Process” has a corresponding meaning).

2. What does this Privacy Policy apply to?

2.1 This Privacy Policy applies to the Processing by us (or others on our behalf) and our successors-in-title, of Personal Information (as defined in paragraph

3.1) relating to You, regardless of the device which You use to access it, which device is capable of using, or enabled to use, the Website including, but not limited to, internet-connected mobile devices and tablets (“Access Device”).

3.1 “Personal Information” refers to personal information about an identifiable person (natural and juristic persons). Other information which might be Personal Information may include:

3.1.1 “device and device event information”: We may collect information such as Your IP address, unique device identifier, the nature of the Access Device which You used to access the Website, the geographic location from which You accessed our site, operating system type and version, system activity, and crashes;

3.1.2 “log information”: When You use the Website, we may automatically collect and store certain information in server logs when You access the Website, which may include Your site activity information, such as details of how, when and for how long You accessed the Website, what links You went to, the amount of content viewed and the order of that Content and the amount of time spent on the Website;

3.1.3 “profile information”: We may collect and Process information and usage data per profile to make targeted recommendations to that profile when logged in to and using the Website; and

3.1.4 “location information”: We may use various technologies to determine Your actual location, such as geographical data from Your Access Device (which is usually based on the GPS or IP location).

3.2 Personal Information does not include information that has been de-identified to the extent that it cannot be re-identified again.

3.3 If You are below the age of 18, You may still access and use the Website and our services with the consent and under the supervision of Your legal guardian(s). We will not knowingly collect information from persons under 18 without the requisite consent to do so.

4. When will we Process Your Personal Information?

4.1 In addition to paragraph 5 and 6 below, Personal Information may be Processed by SA20 in several ways, including, when:

4.1.1 You register as a subscriber of SA20’s online community;

4.1.2 You access, use, refer to, view and/or make use of the Website or services available through the Website;

4.1.4 You submit Your Personal Information to us for any other reason; and

4.1.5 You contact us, by email or telephonically or otherwise, with any queries.

5. How we collect Your Personal Information

5.1 We may collect Your Personal Information in two ways, namely:

5.1.2 passively from Your Access Device when You use the Website.

5.2.1 We may require You to submit certain information in order for You to become a subscriber or to purchase merchandise or tickets from the Website. In addition, we may collect Personal Information from You by asking You specific questions and by permitting You to communicate directly with SA20, for example via email, feedback forms, telephone and site comments.

5.2.2 If You contact us, we may keep a record of that correspondence.

5.2.3 The information we may actively collect from You may include Your:

5.2.3.1 identifying information (for example, Your name, surname, unique identifier, date of birth and physical location);

5.2.3.2 contact details (for example, Your email address and phone number); and

5.2.3.3 any other information which we may request from You, and which You provide, from time to time.

5.3 Passive collection from Your Access Device

5.3.1 Whilst a User may visit the Website without providing any Personal Information, SA20 passively collects some of Your Personal Information from the Access Device which You use to access and navigate through the Website, using various technological means, for instance, using server logs to collect and maintain log information.

5.3.2 The Website utilises first and third-party cookies. This enables us to improve the User’s experience on the Website through various means, such as storing preferences (like keeping a User logged in) or determining aggregate usage behaviour (time on site, number of pages viewed etc.) through web analytics tools like Google Analytics. We also use cookies to provide more relevant display advertising to Users who have visited the Website, using third party tools such as Google Analytics Remarketing.

5.3.3 A cookie is a small piece of data (an alphanumeric identifier) which our computer system transfers to Your Access Device through Your web browser when You visit the Website and which is stored in Your web browser. When You visit the Website again, the cookie allows the site to recognise Your browser. Cookies may store User preferences and other information.

5.3.5 The information which we may passively collect from Your Access Device may include Your identifying information, contact details, device and device event information, site activity information, log information, telephony log information, location information and any other information which You permit us, from time to time, to passively collect from Your Access Device.

6.1 We use the information we collect to provide, maintain, and improve the Website, to provide current content and services, and to protect us, our services and our Users. We constantly strive to improve the Users’ experience, and so we also use the information we collect in order to offer You information and content which is more appropriately tailored for You as far as reasonably possible.

6.2 We may use Your Personal Information:

6.2.1 to retain and make available to You, information on the Website;

6.2.2 as a subscriber, to send You notifications, newsletters, special offers, ticketing information and information about competitions;

6.2.3 to maintain and update our customer, or potential customer, databases;

6.2.4 to maintain and update our subscriber, or potential subscriber, databases;

6.2.5 to fulfil Your requests for certain services;

6.2.6 to diagnose and deal with technical issues and User support queries and other User queries, such as problems with our server, determine the optimal and fastest route for Your Access Device to use in connecting with the Website, and administer, maintain and secure the Website;

6.2.7 to detect, prevent or deal with actual or alleged fraud, security or the abuse, misuse or unauthorised use of the Website and/or contravention of this Privacy Policy;

6.2.8 to conduct market research surveys, product research and development;

6.2.9 to provide You with the latest information about our services, provided You have agreed to receive such information;

6.2.11 to compile non-personal statistical information about browsing habits, click patterns and access to the Website;

6.2.12 to improve the Website, analyse trends and administer the Website, including requesting feedback on content, services and products, address any issues and liaise with Users in that regard;

6.2.13 to keep a record of our communications with You and Your communications with us;

6.2.14 to fulfil any contractual obligations we may have to You or any third party; 6.2.15 to improve User experience and the overall quality of our services;

6.2.16 to, as far as possible, tailor information and/or content for You to ensure that it is presented in the most effective manner for You and for Your Access Device;

6.2.17 to inform You about any changes to the Website, the terms of use, this Privacy Policy or other changes which are relevant to You;

6.2.18 to compile and use statistical information about You and other Users and their access to and use of the Website, browsing habits, click-patterns, preferences, and demographics which we may use to develop, provide and improve the Website, including, recommendations to Users and tailoring information for Users;

6.2.19 to compile, use, disclose and trade with non-personal statistical information about our Users and their access to and use of the Website, browsing habits, click-patterns, preferences, demographics which we may use to develop, provide and improve the Website and our products and services, including targeted advertising to User groups. Please note that the information referred to in this paragraph 6.2.21 is aggregate information about our Users which is de-identified such that it cannot be linked back to identify You;

6.2.20 for security, administrative and legal purposes;

6.2.22 other activities and/or purposes which are lawful, reasonable and adequate, relevant and not excessive in relation to the provision of content, services and/or the Website or such other purpose for which it was collected.

6.3 We will get Your permission before collecting or using Your Personal Information for any other purpose.

7. Compulsory information and consequences of not sharing with us

Only Your email address, name and surname, contact details and such other information as we specify from time to time, constitutes compulsory information. All other information is optional. If You do not agree to share compulsory information with us, then You will not be able to make full use of the features that are offered to Users. If You do not agree to share Your optional information with us, then You might not be able to enjoy all of the features and functionality on the Website.

In the paragraph above, You agree and accept that there is certain compulsory information You must provide us with if You want to enjoy all of the features and functionality on the Website. If You decide not to provide us with such compulsory information, You agree that we may limit certain features and functionality on the Website.

8.1 We will not intentionally disclose, for commercial gain or otherwise, Your Personal Information other than as set out in this Privacy Policy, as permitted by applicable law or with Your permission.

8.2 You expressly agree and consent that Your Personal Information may be shared under the following circumstances:

8.2.1 to our employees, service providers, contractors, commercial partners, dealers and agents if, and to the extent that, they need to know that information in order to Process it for us and/or to provide services for or to us, such as hosting, development and administration, technical support and other support services. We will authorise any information Processing done by a third party on our behalf by entering into written agreements with those third parties governing our relationship with them and containing confidentiality and non-disclosure provisions. Such persons may be disciplined, their contracts terminated or other appropriate action taken if they fail to meet their obligations;

8.2.2 in order to protect our rights, property or safety or that of our customers, employees, contractors, commercial partners, dealers and agents and any other third party;

8.2.3 in order to mitigate any actual or reasonably perceived risk to us, our customers, employees, commercial partners, service providers, contractors, agents or any other third party;

8.2.4 to governmental agencies, exchanges and other regulatory or self-regulatory bodies if we are required to do so by law or if we reasonably believe that such disclosure is necessary:

8.2.4.1 to comply with the law or with any legal process;

8.2.4.2 to protect and defend the rights, property or safety of us, our affiliates or our customers, employees, contractors and agents or any third party;

8.2.4.3 to detect, prevent or deal with actual or alleged fraud, security or technical issues or the abuse, misuse or unauthorised use of our site and/or contravention of this Privacy Policy; and/or

8.2.4.4 to protect the rights, property or safety of members of the public (if You provide false or deceptive information about yourself or misrepresent yourself as being someone else, we may proactively disclose such information to the appropriate regulatory bodies and/or commercial entities).

8.3 We may use Your Personal Information to compile profiles for statistical purposes and may freely trade with such profiles and statistical data, provided that the profiles or statistical data cannot be linked back to You.

8.4 We will get Your permission before disclosing Your Personal Information to any third party for any other purpose.

9. Storage and transfer of Your Personal Information

9.1.2 on the servers of our third party service providers, such as IT systems or hosting service providers. In this event, we will ensure that we have entered into written contracts that require such third party service providers to secure the integrity and confidentiality of Personal Information in its possession by taking appropriate, reasonable technical and organisational measures.

9.2 From time to time, SA20 and its service providers may need to transfer to and/or store Your Personal Information on servers in a jurisdiction other than where it was collected, and we hereby notify You, and You acknowledge, that such jurisdiction may not have comparable data protection legislation.

9.3 If the jurisdiction to which Your Personal Information is transferred does not have laws which provide for the protection of Personal Information in a manner which is at least similar to the protections afforded under South African law, we will take reasonably practicable steps to ensure that Your Personal Information is adequately protected in that jurisdiction.

10.1 We take appropriate reasonable technical and organisational measures to secure the integrity of Personal Information, using accepted technological standards to prevent unauthorised access to or disclosure of Your Personal Information, and protect Your Personal Information from misuse, loss, alteration or destruction.

10.2 Even by taking the above measures when Processing Personal Information, we do not guarantee that Your Personal Information is 100% secure. Subject to the provisions of this clause 10, as far as the law allows, we will not be liable for any loss, claim and/or damage arising from any unauthorised access, disclosure, misuse, loss, alteration or destruction of Your Personal Information.

In this paragraph, You acknowledge that You know and You accept that technology is not absolutely secure and there is a risk that Your Personal Information will not be secure when Processed by means of technology. We do not promise that we can keep Your Personal Information completely secure. You will not be able to take action against us if You suffer losses or damages in these circumstances.

11. Retention of your Personal Information
